PROMOTION TERMS & CONDITIONS

1. Promoter

This promotion is conducted by FOUND. Goods Co Pty Ltd

("Promoter")

2. Promotion Period

The promotion commences on the date advertised by the Promoter and concludes when all Scratch & Win cards have been distributed or on the advertised closing date, whichever occurs first.

The Promoter reserves the right to end the promotion earlier if all promotional cards have been exhausted.

3. Eligible Entrants

Participation is open to:

• Australian residents aged 18 years or older;
• Persons who purchase an eligible FOUND Beer product from a participating licensed venue in Western Australia during the Promotion Period.

The following persons are ineligible:

• Employees of FOUND. Goods Co Pty Ltd;
• Participating venue owners and staff directly administering the promotion;
• Immediate family members of the above.

Proof of age may be requested before a prize is awarded.

4. How to Participate

To participate:

1. Purchase any eligible FOUND Beer product from a participating licensed venue.

2. Receive one (1) Scratch & Win card for each eligible purchase (unless otherwise stated by the venue).

3. Scratch the designated panel to reveal whether you have won an instant prize.

Only original Scratch & Win cards supplied by the Promoter are valid.

5. Prizes

Winning prizes are determined instantly by the message printed beneath the scratch panel.

The maximum value of any individual prize is:

AUD $15

6. Prize Redemption

Winning cards must be redeemed in accordance with the instructions printed on the card.

Winning Scratch & Win cards must:

• Be original;
• Be intact;
• Not be altered;
• Be legible.

The Promoter may refuse any card that appears copied, damaged, fraudulent, forged, tampered with or illegible.

Prizes must be claimed within the redemption period advised by the Promoter.

Unclaimed prizes remain the property of the Promoter.

7. Prize Conditions

Prizes:

• Are not redeemable for cash;
• Cannot be exchanged;
• Cannot be transferred;
• Cannot be substituted except at the Promoter's discretion.

Should any prize become unavailable, the Promoter reserves the right to substitute a prize of equal or greater value.

8. Responsible Service of Alcohol

Where a prize includes alcohol:

• Recipients must be at least 18 years of age;
• Alcohol will only be supplied in accordance with the Liquor Control Act 1988 (WA);
• Participating venues reserve the right to refuse service in accordance with responsible service of alcohol obligations.

Nothing in this promotion requires a venue to supply alcohol where doing so would breach any law.

9. Lost or Damaged Cards

The Promoter accepts no responsibility for Scratch & Win cards that are:

• Lost;
• Stolen;
• Damaged;
• Destroyed;
• Illegible.

Replacement cards will not be issued.

10. Fraud

The Promoter reserves the right to verify the validity of any claim.

Any person who:

• tampers with the promotion;
• reproduces cards;
• alters winning cards;
• engages in fraudulent conduct;

may be disqualified and may be referred to the appropriate authorities.

11. Limitation of Liability

To the maximum extent permitted by law, the Promoter excludes all liability for:

• lost prizes;
• indirect loss;
• consequential loss;
• technical errors;
• printing errors;
• lost Scratch & Win cards.

Nothing in these Terms excludes rights available under the Australian Consumer Law.

12. Privacy

Where personal information is collected for prize fulfilment, the Promoter will use that information solely for administering the promotion unless otherwise authorised by the participant.

Personal information will be handled in accordance with the Privacy Act 1988 (Cth).

13. Cancellation or Variation

If this promotion cannot proceed as planned due to circumstances beyond the reasonable control of the Promoter including fraud, technical issues, natural disasters, government restrictions or any other event, the Promoter reserves the right to modify, suspend or cancel the promotion.

14. Promoter Decisions

The Promoter's decision regarding any aspect of the promotion is final.

No correspondence will be entered into.

15. Governing Law

These Terms & Conditions are governed by the laws of Western Australia.

Participants submit to the exclusive jurisdiction of the courts of Western Australia.
